2. Applicability
These general terms and conditions apply to every offer by Simply Be You and to every distance contract concluded between the entrepreneur and the consumer.

By placing an order, you agree to these terms and conditions.

3. The Offer
We ensure that product descriptions are as complete and accurate as possible. Obvious mistakes or errors in the offer do not bind us.

Images are a truthful representation of the products offered, but colors may vary due to screen settings.

4. The Agreement
The agreement is concluded when you accept the offer and meet the stated conditions.

We confirm your order by email. Until you receive confirmation, the agreement is not final.

We reserve the right to refuse an order if there are valid reasons to do so.

5. Prices
All listed prices include VAT and exclude any shipping costs, unless stated otherwise.

Obvious errors in pricing do not bind us. If a product is offered at an incorrect price by mistake, we will contact you before processing the order.

6. Payment
Payment must be made using the payment methods offered at checkout.

We reserve the right not to process orders until payment has been received.

7. Delivery
We strive to deliver your order as quickly as possible.
Unless explicitly agreed otherwise, delivery takes place within 14 days after concluding the agreement.

If delivery within 14 days is not possible, we will inform you in a timely manner. In that case, you have the right to cancel the agreement free of charge.

The risk of damage and/or loss of products rests with us until the moment of delivery to you or a third party designated by you.

8. Right of Withdrawal (Legal Return Right)
You have the right to cancel your order within 14 days of receipt without giving a reason.

After cancellation, you have an additional 14 days to return the product.

You will receive the full order amount, including shipping costs. Only the costs for returning the product to our webshop are your responsibility unless otherwise agreed.

If you exercise the right of withdrawal, the product must be returned unused, in its original condition and packaging.

We will refund the amount due within 14 days of receiving notification of your return, provided the product is received in good condition.

9. Exclusion of Right of Withdrawal
The right of withdrawal does not apply to:

  • Products made according to the consumer's specifications
  • Personalized items
  • Products that cannot be returned for hygiene reasons if the seal has been broken

10. Conformity and Warranty
We guarantee that our products comply with the agreement, the stated specifications, reasonable requirements of durability, and legal provisions.

You are entitled to a sound product. If a product is defective or faulty, please contact us within a reasonable period.

In addition to the statutory warranty, additional manufacturer warranties may apply.

11. Liability
We are not liable for indirect damage, consequential damage, loss of profit, or data loss.

Our liability is limited to the amount of the relevant order, unless there is intent or gross negligence.

This limitation does not apply to liability that cannot be legally excluded.

12. Intellectual Property
All content on the website, including texts, images, logos, and designs, is the property of Simply Be You and may not be used or reproduced without written permission.

13. Privacy and Data Protection (GDPR)
We process personal data in accordance with the General Data Protection Regulation (GDPR).

We take appropriate technical and organizational measures to protect your data.

14. Complaints Procedure
Do you have a complaint? Please contact us at simply-beyou@outlook.com. We aim to respond substantively within 14 days.

15. Applicable Law
This agreement is governed exclusively by Dutch law.

Disputes will be submitted to the competent court in the Netherlands.

16. Changes to Terms and Conditions
We reserve the right to modify these terms and conditions. The most current version is always available on our website.
